Arizona Supreme Court Denies DACA Students In-State Tuition

The Arizona Supreme Court [official website] issued an order [text] Monday denying in-state tuition for individuals who benefit from the Deferred Action for Childhood Arrivals (DACA) [official website] program.

"Last June, the board announced that until a decision was reached by the Supreme Court in the State of Arizona v. Maricopa County Community College District case, it would interpret its policies to allow eligible DACA students to pay in-state tuition". On Monday, the Arizona Supreme Court ruled that DACA recipients are ineligible for in-state tuition at Arizona public colleges.

The Court granted review on February 13, 2018, exclusively on the issue of "whether DACA recipients who are lawfully present in this country while they are participating in the DACA program are eligible for resident tuition".

According to the publication, more than 2,000 DACA recipients pay in-state rates at community colleges or state universities in Arizona. Bill Ridenour is the chairman, and said, "Obviously the universities have anticipated this ruling, or an adverse ruling and they've used this time to be able to start talking to the DACA students and they've also used this time to be able to start lining up private support for scholarship purposes perhaps for the DACA students so that it's not such an abrupt increase in their tuition". "Residents pay $86 per credit hour at the Maricopa Community Colleges, compared with $241 for non-residents", according to the Republic.

Petra Falcon, executive director of Promise Arizona, said in a statement the ruling "basically declares that the future of thousands of Arizona Dreamers simply doesn't matter".

A student who attended an Arizona high school for at least three years, graduated from an Arizona high school and is "lawfully present" in the state is eligible for a tuition rate of 150 percent of in-state tuition. And that, he said, means the state and its taxpayers would not be illegally subsidizing the cost of education for dreamers. Egurrola, who is 24, said that after a moment of disbelief, she urged her friends that this fight had been a long one, and they would find a solution.
